Affiliate Program Terms

These Affiliate Program Terms (the "Program Terms") form a binding agreement between you ("you", "Affiliate") and the operator of the Monty service ("Monty", "we", "us", "Provider", identified in Section 23 of the Terms of Service). By joining the affiliate program, claiming an affiliate code, or posting an affiliate link, you agree to these Program Terms. If you do not agree, do not take part in the program.

These Program Terms add to the Terms of Service and the Privacy Policy; they do not replace them. On matters concerning the affiliate program, these Program Terms control in the event of a conflict; everything else is governed by the Terms of Service.

The affiliate program is not an investment offering, a security, a franchise, or an offer of employment, and no level of earnings is guaranteed. We promise no income: what you earn depends entirely on how many people you refer actually pay for Monty and keep paying.

1. Definitions

Program - the Monty affiliate program described at partner.monty.fast and in the Partner Dashboard.

Partner Dashboard - the area of partner.monty.fast where an Affiliate sees their code, statistics, and balance.

Affiliate Code - the unique code an Affiliate claims in the Dashboard. The same code forms both the Affiliate Link and the Promo Code.

Affiliate Link - a URL of the form monty.fast/r/<code>.

Promo Code - the same code in upper case, entered at checkout.

Referred Customer - a user attributed to an Affiliate under Section 4.

Qualifying Payment - a payment for a Monty plan actually received from a Referred Customer and not refunded, net of sales taxes (VAT, GST, sales tax and the like), payment-processing fees, and refunded amounts. Commission is calculated on this amount, not on the list price.

Commission - the Affiliate's fee, calculated under Section 5.

Holding Period - the 30 calendar days following a Qualifying Payment (Section 6).

Payable Balance - Commission that has cleared the Holding Period and has not been reversed.

2. Eligibility

2.1. You must be at least 18 years old (or older, if your country requires it) and able to enter into a binding contract.

2.2. Individuals and organisations may both take part. If you act on behalf of an organisation, you confirm that you are authorised to bind it.

2.3. We may decline or end participation at our discretion, including where your promotional methods are incompatible with the Monty brand. Declining does not deprive you of Commission already accrued on Qualifying Payments made before that point, except in the cases in Section 11 (violations).

2.4. You may not take part if you are located in a comprehensively sanctioned country or are on a sanctions list (including OFAC SDN, EU and UK sanctions lists). See Section 14.

3. The Affiliate Code

3.1. You claim your code in the Dashboard. It must consist of latin letters, digits, and hyphens, be at least 3 characters long, and contain at least one letter.

3.2. Codes are issued first-come, first-served: a code already taken is not issued again.

3.3. We may reject or change a code that is misleading, infringes third-party rights, imitates Monty or our official channels (for example "monty-official", "monty-support"), or contains offensive or unlawful elements. We will give notice where we can.

3.4. The code and link are granted to you personally. You may not sell, rent, transfer, or pool them with anyone else's codes.

4. How a customer is attributed to you

4.1. Attribution lasts 90 days. A click on your Affiliate Link attributes that visitor to you for 90 calendar days from the click. If someone clicks today and pays three months later within that window, the customer is yours.

4.2. Last click wins. If a visitor clicks the links of several Affiliates within the attribution window, the customer is attributed to whoever was clicked last. Each new click restarts the 90-day count.

4.3. A Promo Code beats a click. If a Promo Code is entered at checkout, the customer is attributed to the owner of that code regardless of any earlier click.

4.4. Attribution relies on cookies and our server-side records. We cannot guarantee attribution where the visitor cleared cookies, switched device or browser, used private mode or a blocker, declined cookies in the consent banner, or where more than 90 days passed between the click and the payment. Losing attribution this way is not a breach of these Program Terms by us.

4.5. Lifetime. For as long as a Referred Customer stays attributed to you and keeps paying for Monty, Commission accrues on each of their Qualifying Payments, renewals included. If they stop paying, accrual pauses; if the same account resumes paying, accrual resumes.

4.6. Attribution ends if the customer was referred in breach of Section 10, and on termination of your participation under Section 11.

4.7. The click, sign-up, and payment figures in the Dashboard are informational. Where they differ from our billing records, our billing records govern.

5. Rate and tiers

5.1. The base first-level Commission rate is 25% of each Qualifying Payment. The rate rises by tier, based on the number of Qualifying Payments by your Referred Customers over the rolling last 30 days:

5.2. The window is rolling: your tier can go up and it can go down. The rate applies to payments received while that tier is in effect; Commission already accrued is not recalculated retroactively.

5.3. Second level. If an Affiliate you referred (a sub-affiliate) brings in their own Referred Customers, you additionally earn 5% of each of those Qualifying Payments. This is paid on top and does not reduce the sub-affiliate's Commission. The program is limited to two levels: payments from customers referred by a sub-affiliate's own sub-affiliates generate no second-level reward. Combined Commission across both levels on a single payment does not exceed 32%. The same holding period and refund reversal (Sections 6 and 7) apply to second-level earnings.

5.4. The extra tier perks (priority payout, featuring, a personal manager, custom terms) are granted at our discretion, are not a monetary obligation, and may change.

5.5. We may agree custom terms with an individual Affiliate in writing. Those terms prevail over this Section 5.

6. Accrual, holding, and reversal

6.1. Commission accrues when a Qualifying Payment is received and appears in the Dashboard as held.

6.2. The Holding Period is 30 calendar days. After it, the Commission moves into your Payable Balance. The hold covers the window in which refunds, cancellations, and chargebacks can still happen.

6.3. Reversal. If a Qualifying Payment is refunded, cancelled, charged back, or found to be fraudulent, the matching Commission is cancelled. If it was still held, it simply never reaches your Payable Balance. If it was already paid out, the amount is deducted from your next payouts.

6.4. If a reversal exceeds your Payable Balance, the negative amount carries into later periods. We do not claim money back from you, except in cases of fraud or another breach of Section 10, where we may recover amounts already paid.

6.5. On a partial refund, Commission is recalculated pro rata on the amount we actually keep.

7. Payouts

7.1. Payouts run once a month, on the 1st. If the date falls on a weekend or public holiday, the payout runs on the next business day.

7.2. The minimum payout is USD 50. A Payable Balance below the threshold rolls over and keeps accumulating.

7.3. All amounts are stated and calculated in US dollars.

7.4. Available payout methods are the USDC stablecoin or a bank transfer. You agree your method and details with us before your first payout. Until a method is set, your Payable Balance keeps accumulating and does not expire.

7.5. Transfer fees. Blockchain network fees and correspondent-bank fees are yours and are deducted from the payout unless agreed otherwise. We do not compensate exchange-rate movement, exchange fees, or your own cost of cashing out.

7.6. Correct details. You are responsible for the payout details you give us. Funds sent to a wrong address or account you provided count as paid; blockchain transfers are irreversible and we cannot recall them.

7.7. We may hold a particular payout for up to 90 days where we have a reasonable suspicion of fraud, or where a check under Section 14 requires it. We will notify you at the email address on your account.

8. Taxes and your status

8.1. You are an independent contractor. These Program Terms create no employment, agency, partnership, franchise, or joint venture. You may not act on behalf of Monty, commit Monty to anything, or present yourself as our employee.

8.2. You determine your own tax status and declare and pay all taxes, levies, and contributions on what you earn, in your own jurisdiction. Amounts paid are stated exclusive of such taxes.

8.3. We may request tax forms or documents evidencing your identity and tax residency (for example a W-9 or W-8BEN) and hold payouts until we receive them. Where applicable law requires us to withhold tax at source, we will withhold and remit the balance.

8.4. You bear your own promotional costs. We do not reimburse advertising spend, production costs, or other expenses.

9. How you may promote

9.1. You may place your Affiliate Link and Promo Code in your own channels: videos and their descriptions, stories, posts and pinned messages in Telegram and other messengers, your profile bio, your own site or blog, and your own email list built with the recipients' consent.

9.2. You may use the materials in the Dashboard's Promo Kit and adapt them to your own voice.

9.3. Disclosure is mandatory. When you post a link or a code, you must clearly and conspicuously disclose that you are compensated - in your audience's language, in the same material that carries the link (for example "ad", "affiliate link", "I earn a commission"). You are responsible for complying with applicable advertising and disclosure rules, including the FTC Endorsement Guides in the US, your country's advertising law, and the platform's own rules. This obligation applies whether or not the platform requires it.

9.4. You are responsible for your material complying with the rules of the platforms you post on. A platform suspending your account is not a claim against us.

10. What is prohibited

You may not:

  • Self-refer. Use your own code for your own payments or those of people and organisations affiliated with you, or create accounts in order to earn Commission on your own subscription.
  • Incentivise traffic. Offer money, cashback, giveaways, points, or other incentives in exchange for a click or a payment, unless agreed with us in writing.
  • Spam. Send bulk messages without the recipients' consent, DM strangers, post spam comments, or push your link in other people's chats and under other people's videos.
  • Bid on our brand. Buy ads on "Monty", "monty.fast", their variants and misspellings, or run ads that point directly at monty.fast.
  • Impersonate us. Register domains, accounts, or channels that can be confused with official Monty, or post content that suggests you are Monty.
  • Use coupon and cashback sites. Place your code on coupon aggregators, promo-code sites, or cashback services.
  • Make false promises. Claim guaranteed income, guaranteed views or followers, or invent Monty features, prices, reviews, results, or partnerships.
  • Fake the numbers. Use bots, emulators, click farms, fake accounts, automated clicking, or any attempt to distort the statistics.
  • Place us badly. Put the link next to adult content, violence, hate speech, disinformation, gambling, pirated content, or other unlawful material.
  • Work around the rules. Interfere with the Service, tamper with tracking parameters, or hide your traffic source.

11. Review, suspension, and termination

11.1. We may review traffic quality and referral sources and ask you to explain your promotional methods.

11.2. On a breach of Section 10 we may, proportionately to the breach: cancel the attribution of affected customers, cancel the matching Commission (including Commission already in your Payable Balance), suspend your participation, or end it.

11.3. In cases of fraud - faked numbers, fake accounts, self-referral through workarounds - we may cancel your entire Payable Balance and recover amounts already paid that resulted from the breach.

11.4. You may leave the Program at any time by writing to us. On voluntary exit, your Payable Balance is paid on the next payout date, provided it meets the threshold.

11.5. We may end your participation without cause on 30 days' notice. In that case Commission on Qualifying Payments received before the end date accrues and is paid as usual, and attribution of your customers ends on that date.

11.6. We may close the Program entirely on at least 30 days' notice to participants. Commission accrued by then is paid out, and the USD 50 threshold does not apply to that final payout.

11.7. Sections 6, 8, 10, 11, 13, 15, 16, and 17 survive termination.

12. Inactivity

12.1. If your Payable Balance has not reached the threshold and there has been no Qualifying Payment on your Affiliate Link for 12 consecutive months, and you have not signed in to the Dashboard, we may cancel that balance.

12.2. We may only do so after giving at least 30 days' notice to the email address on your account. Any action by you in that window - signing in, replying, requesting a payout - cancels the forfeiture and restarts the count.

12.3. This Section does not apply where the payout did not happen through our fault or because of a hold under Section 7.7 or Section 14.

13. Brand and materials

13.1. For the duration of your participation we grant you a non-exclusive, revocable, non-transferable licence to use the Monty name, logo, and Promo Kit materials solely to promote Monty under these Program Terms.

13.2. You may not alter the logo, use it as part of your own logo, or register confusingly similar marks, domains, or accounts. All rights in the Monty brand stay with us.

13.3. The licence ends automatically when your participation ends. After that you must remove Monty branded materials within a reasonable time and stop presenting yourself as a current partner. You do not have to take down links in archived videos you cannot technically edit - but they stop earning Commission.

13.4. You keep the rights in material you created yourself. You grant us a non-exclusive right to quote and show such public material in our channels and gallery, with attribution.

14. Compliance and sanctions

14.1. You confirm that you are not located in a comprehensively sanctioned country, are not on a sanctions list (OFAC SDN, EU and UK sanctions lists and the like), and are not acting for anyone who is.

14.2. We may request documents evidencing your identity and your right to be paid, and hold a payout until a check completes, where applicable law, our payment providers' rules, or a reasonable suspicion requires it.

14.3. If paying you becomes unlawful for us, we may end your participation and withhold payment to the extent the law requires. We will tell you, to the extent we are permitted to.

15. Personal data

15.1. Your data (account, statistics, payout details, and payout history) is processed under the Privacy Policy. We are the controller of that data.

15.2. We do not pass you the personal data of Referred Customers. The Dashboard shows aggregate statistics and de-identified events only.

15.3. If you collect personal data from your own audience (for a mailing list, say), you are the controller of that data and are responsible for collecting it lawfully and for holding the consents.

16. No guarantees and limitation of liability

16.1. The Program is provided "as is". We do not guarantee any level of earnings, any number of clicks, sign-ups, or payments, or that tracking will be uninterrupted or error-free.

16.2. The figures in the calculator at partner.monty.fast, the examples in the Dashboard, and the Promo Kit are illustrative. They are not a forecast and not a promise of income.

16.3. We are not liable for lost profit, for Commission missed because attribution was lost for the reasons in Section 4.4, for what platforms do to your accounts, or for indirect or incidental damages.

16.4. Our total liability to you under these Program Terms for any 12-month period is limited to the Commission actually paid to you in that period, or USD 100 if no payout was made.

16.5. The limits in this Section apply to the fullest extent permitted by applicable law and do not limit liability that cannot be limited by law, including for wilful misconduct and gross negligence.

16.6. You indemnify us for losses arising from your breach of Section 9, Section 10, or third-party rights, on the terms of Section 15 of the Terms of Service.

17. Changes to these terms

17.1. We may change these Program Terms. The last-updated date is shown at the top of this document.

17.2. We give at least 30 days' notice of changes to rates, the threshold, the Holding Period, attribution rules, or payout methods, by email to the address on your account or in the Dashboard. Changes do not apply retroactively to Commission already accrued before the change takes effect.

17.3. Continuing to take part after a change takes effect means you accept it. If you do not accept it, you may leave under Section 11.4 and take your accumulated Payable Balance with you.

17.4. Clarifications that do not change the economics of the Program (corrections, wording, editing) take effect when published.

18. Governing law and disputes

18.1. The governing-law and dispute-resolution provisions in Section 21 of the Terms of Service apply to these Program Terms, including the mandatory informal step: before bringing a claim, write to [email protected] and allow 30 days to resolve it.

18.2. Taking part in the Program is a business activity, not consumer use of the Service. Consumer-protection provisions generally do not apply to the relationship under these Program Terms, except where the mandatory law of your country provides otherwise.

19. General

19.1. These Program Terms, together with the Terms of Service and the Privacy Policy, are the entire agreement between us about the Program.

19.2. You may not assign your rights under these Program Terms without our written consent. We may assign ours to a successor on a reorganisation or sale of the business.

19.3. If any provision is invalid, the rest stay in force.

19.4. Not enforcing a right does not waive it.

19.5. Where the language versions of these Program Terms differ, the Russian version prevails.
